Terms of Service

1. Acceptance of Terms

By creating an account or using LightsOnAlert ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a binding agreement between you and CurmudgInnovation, LLC ("we," "us," or "our").

2. Description of Service

LightsOnAlert is an informational alert and monitoring service that aggregates publicly available hazard data — including National Weather Service (NWS) alerts, earthquake reports, wildfire perimeter data, and local storm reports — and delivers notifications to registered users based on the geographic proximity of those hazards to user-defined locations ("places").

3. Informational Purpose Only — Not an Emergency Service

LightsOnAlert is NOT a substitute for official emergency management systems, government alerts, or emergency services.

• In any emergency, call 911 and follow instructions from local emergency management officials.
• Do not rely solely on LightsOnAlert notifications for personal safety decisions.
• LightsOnAlert does not replace Wireless Emergency Alerts (WEA), NOAA Weather Radio, or other official notification systems.

4. No Guarantee of Delivery or Accuracy

We make no representations or warranties that:

• Alerts will be delivered in real time or within any specific time period.
• All hazards near your monitored places will generate alerts.
• Third-party data sources (NWS, USGS, NIFC, IEM) are accurate, complete, or current.
• SMS or email delivery will succeed (carrier delays, spam filters, and other factors may prevent delivery).

Hazard data is sourced from public APIs and may contain errors, omissions, or delays. Alert boundaries are approximate.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CURMUDGINNOVATION, LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF — OR INABILITY TO USE — THE SERVICE, INCLUDING BUT NOT LIMITED TO:

• Property damage, personal injury, or loss of life resulting from reliance on the Service.
• Missed, delayed, or inaccurate alerts.
• Errors or outages in third-party data sources or communication carriers.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

6. User Responsibilities

• You are responsible for maintaining current contact information (phone number, email address) in your account settings.
• You are responsible for verifying that your monitored places are accurately located.
• You must have an independent emergency plan and must not rely on LightsOnAlert as your sole source of hazard awareness.
• You are responsible for any charges from your mobile carrier for SMS messages received through the Service.

7. Geographic Restrictions

LightsOnAlert is intended for use within the United States only. The Service and its data sources are not designed to cover hazards outside the United States. Access from outside the United States is not supported.

8. Account and Subscription

Subscriptions are billed annually. You may cancel at any time; cancellation takes effect at the end of the current billing period. Refunds are not issued for unused portions of a subscription term. We reserve the right to modify pricing with 30 days' notice to active subscribers.

9. Modifications to the Service and Terms

We reserve the right to modify, suspend, or discontinue the Service at any time. We may update these Terms at any time; continued use of the Service after notice of changes constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved in the courts of Tarrant County, Texas.
